This 4-hour online course, led by Rashpal Soomal, Partner at Eversheds Sutherland International, demonstrates the key legal development constraints that every developer needs to understand.
The course covers: restrictive covenants, boundaries, trespass, adverse possession, easements, rights of way, nuisance, derogation from grant and quiet enjoyment amongst other less encountered impediments.
In addition, key legal principles are explained, together with how those principles have been applied in decisions handed down by courts – further illustrated by everyday practical examples, some common and others more obscure. Examples include references to balconies; vaults; fire escapes; airbricks, vents and flues; and advertising signs, amongst others.
The course also explores the remedies available, covering injunctions and monetary damages, and practical risk mitigation solutions (including insurance).
